Headnote:Effect of non-consideration of explanation offered by a Government Servant while considering promotion - confidential report - right to see

       Held : An adverse report in a confidential roll cannot be acted upon to deny promotion unless it is communicated to him so that he can improve his work and conduct An opportunity should be given to him to give an explanation If the Government passes an order without considering his explanation and deciding whether adverse report was justified the action of the Government cannot be justified
