Headnote:INDIAN EVIDENCE ACT, Sections 61 to 56 and 67 to 73 - Proof of Document - Merely producing 8 document and proving its genuineness without examining the writer thereof - Not sufficient to prove the truth of the contents of Document.

       Held : If the truth of the contents itself is in issue the proof of document viz., proving the genuineness and co: tents by producing the same would not be sufficient to prove the truth of the cont"l1ts of the document unless the writer of the document is examined. In the absence of such evidence, the contents only constitute here say evidence. Its probative value is very weak, in the absence of the evidence of the author who wrote it.
