Headnote:EASEMENTS ACT 1882: Sec18 Illustration B: Right to privacy of a neighbour - Customary right

Held : It is now well settled that pleadings are not to be construed strictly, on the other hand to be construed very broadly So construed they give the following indication, that the ladies in India have a right to privacy, be it where they liver or to which community or religion they belong In the neighbourhood that right to privacy also is available and it is our national character The plaintiffs in their amended plaint in paragraph 3 (a) pleaded that there is a customary right and the neighbours have that right and it is only generally denied without specific denieal, it must be deemed to have been admitted There when the fact is admitted the need to prove it is obviated
