Headnote:AP BOARD STANDING ORDERS – Order 15 [2] [3] Note [iii] and [18] and condition No20 of D-Form Patta - Mandal Revenue Officer has no power to cancel D-Form Patta on the ground of misrepresentation or suppression of fact Only Collector has power to cancel the same under Paragraph 18 of Board Standing Order 15

       Held : In the instant case, the Patta is sought to be cancelled on the ground of suppression of material facts and misrepresentation of facts On these grounds, the Collector has the power to cancel the Patta under- Paragraph-18 of the Board Standing Order 15 The Mandal Revenue Officer has no power to do so It is true that note (iii) to Board Standing Order 15[12][3] provides that Tahsildar and Deputy Tahsildar who are the assigning authorities shall be the authorities competent to order resumption in case of breach of the conditions of grant which are those enumerated in Sub Para (3) of Para [12] to which the said note is appended but not condition No 20 of D-Form Patta
