JUDGMENT :

P. CHANDRA REDDY, O.C.J.:— This appeal was placed before a Bench having regard to the market value of the subject-matter of the appeal. It relates to a will executed by one Rajyalakshmamma on the 22nd July 1947 which was registered on the 24th December 1947. By and under the will, the testatrix made dispositions in favour of three individuals including one Somasi Venkatramayya. Rajyalakshmamma, who was the daughter of one Tholeti Venkatramayya, was married to Rajah Gadicherla Venkatasubbarao, but her married life did not prove to be a happy one which led her husband to take a second wife. She also instituted a suit for maintenance against her husband which resulted in a sum of Rs. 50/- per month being awarded to her. Ever since her separation from her husband, she took up her residence with her parents. Her father brought in the aforementioned Venkatramayya into the family in or about the year 1908 to help him in the management of his estate, he having become old. Venkataramayya began to live with Rajyalakshmama and her father.
