JUDGMENT :

1. The plaintiff has filed this appeal aggrieved by the judgment and decree in O.S. 165/58 of the 4th Additional Judge, City Civil Court, Hyderabad, dismissing his suit.

2. The plaint allegations are that on 18-11-1957 public auctions were held by the Assistant Director of Mines and Geology of the right to obtain leases of certain land areas for a period of three years from 1-1-1958 The plaintiff was one of the bidders at the auction. In consequence of certain persons continuously railing their bids, the auctions took a very abnormal turn and the amount finally offered by these persons or by others including the plaintiff was utterly fantastic being several times larger than the sums which the bidder could hope to realise by the sale of the sand in the auctioned areas. The plaintiff being perplexed and dazed by the wholly unexpected, turn of events was unable to bring to anything approaching a calm judgment to bear on the situation and he went on mechanically increasing his bids lest he should altogether lose his position as a contractor of the Department.
