JUDGMENT :
1. Defendants 1 and 2 laid this appeal against the decree for possession. Cross-objections are by the respondent-plaintiff against the decree dismissing the suit for declaration of title to and for mesne profits. As they arise out of the same suit, they are disposed of together.
2. The respondent sought declaration of title to, possession of and mesne profits in respect of Ac. 9-00 of land bearing S. Nos. 627, 629 and 640 situate in Gardepalle village of Nalgonda District. It is his case that he entered into an agreement of sale of lands under Ex. A-2, dt. May 30, 1960 and paid the entire consideration of Rs. 2,200/- and was put in possession thereof. Subsequently, the registered sale-deed Ex. A-1, dated December 4, 1965 was executed in his favour for Rs. 3,000/- and was continuing in possession and enjoyment of the property, While so, when his possession was sought to be interdicted, he laid in 1962 the proceedings under Sec. 107 of the Code of Criminal Procedure; ultimately he was found not in possession and there was a dispute of title, relegating him to the suit.
