ORDER :

1. This C.R.P. is filed by the petitioner-defendant challenging the order, dt. 7-8-1990 passed by the Subordinate Judge, Bhimavaram made in S.R. No. 6744 /89 & I.A. 1159/89 in O.S. 67/89 holding that the F.S. Memo is recorded and that the petitioner-Plaintiff cannot request the court to stop recording of F.S. Memo.

2. A memo dated 4-11-1989 signed by both the parties and their respective counsel was filed by both sides in the lower court on 21-2-1990 stating that the defendant paid Rs. 15,250 / - to the plaintiff and it may be recorded that full satisfaction has been made in the claim. The petitioner-plaintiff filed another petition I.A., in S.R. No. 6744/89 stating that though full satisfaction memo was obtained by the defendant, the amount has not been paid and further stating that the memo would be filed only after the amount is paid. The plaintiff has stated that in order to defraud him the memo might have been filed into court and therefore F.S. Memo may be rejected.

3. The case of the defendant is that he paid the entire amount as per the memo whereas the case of the plaintiff is that he did not receive the amount under the memo. The learned counsel for the plaintiff in
