ORDER :

1. Criminal Petition No. 552 of 1994 is filed under Section 482 Cr.P.C. to quash the orders in M.C. No. 10 of 1993 dated 14-2-1994 passed by the first respondent sub-Divisional Magistrate and Revenue Divisional officer, Eluru, West Godavari District. Crl.M.P. No. 663 of 1994 is filed for suspending the operation of the first respondent's order dated 14-2-1994 in M.C. No. 10 of 1993 pending disposal of the criminal petition. To understand the crux of the litigation and the necessity for the present proceedings, a few facts have to be narrated.

2. One Brahmadevudu, without issues, was living with his first wife who died in 1991 issueless. While his wife was living with him, the present third respondent Abburi Urmilamma @ Duggirala Urmilamma was said to be living with them as their servant- maid. It is alleged that after the death of the first wife in 1991, the abovesaid Brahmadevudu appears to have married the erstwhile servant-maid Urmilamma. Of course, this fact of marriage is denied by the opposite party. This Brahmadevudu is supposed to have executed a will on 8-2-1994 according to the contentions of the petitioners.
