ORDER:

1. The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-

    “to issue a Writ, Order or Directions(s) more particularly one in nature of Writ of Mandamus declaring the action of the respondents in not allowing the petitioners to attend the interview for the post of Kamati and for the post of cook in spite of working in the same post since, 2006 on contract / outsourcing basis pursuant to the provisional Merit List showing the names of the petitioners is highly illegal arbitrary unjust unconstitutional and violation of Principles of Natural Justice and consequently direct the respondents to allow the petitioners to attend the interview by duly considering the past 12 years of service and consider the petitioners candidature for appointment in respective posts and pass such other orders in the circumstances of the case”.

2. The brief facts of the case are that the petitioners Nos.1 and 2 were appointed as Kamati and Cook respectively on 12.06.2006 in Social Welfare Department by daily wages on contract. Later the 1s
