Aravind Kumar J.—These two writ petitions are by the management of Sri Ramakrishna Pre-University College, Mangalore, questioning the order passed by Labour Court dated September 8, 2011 in Application No. 4/2010 and 2/2010 respectively. Heard Sri Ramachandran, learned Counsel appearing for petitioner and Sri Y. Rajendra Prasad, learned Counsel appearing for respondents. Perused the impugned order as also the records.
2. Respondents filed Applications under Section 33(C-2) of the Industrial Disputes Act, 1947 praying for computation of the amount towards Leave Encashment for a period of 240 and 180 days respectively and to direct the management to pay the same along with interest at 18% p.a. with costs.
3. It was contended by respondents that they were serving as Attenders in the petitioner college and after working continuously for a period of 12 years and 18 years respectively, they have opted for Voluntary Retirement and at the time of leaving the job they were drawing salary of Rs. 4,380/- per month and Rs. 5,928/- per month respectively inclusive of Dearness Allowance per month.
