1. Heard the learned counsel Sri. Nagendra Naik K. for the petitioner and the learned Addl. Govt. Advocate Sri. T.S. Mahantesh on behalf of respondent Nos. 1 to 3 and the learned Senior Counsel Sri. A.S. Ponnanna along with the learned counsel Sri. Rajeswara P.N. for the respondent No. 4 and the learned counsel Sri. P.V. Chandrashekar for the respondent No. 5.

Brief facts:

The case of the petitioner is that it is a registered body and that the same is registered under the Karnataka Societies Registration Act and that being aggrieved by the appointment of 4th respondent despite him not possessing the statutorily stipulated qualification and being further aggrieved by the inaction and wrong actions of respondent Nos. 2, 3 and 5 in appointing and allowing the 4th respondent to continue in the service against the post reserved for Scheduled Castes, has preferred the instant writ petition. That despite the notification not reserving any post in favour of candidates hailing from the backward class, the appointment of the 4th respondent, who belongs to a backward class, has been appointed against the quota for the reserved category despite the 4th respondent not possessing the eligib
