3. With the consent of all the counsels the matters are taken up for final disposal.
In W.P.No.30417 of 2008 and W.P.No.107937 of 2018:

The petitioners in W.P.No.30417 of 2008 and the petitioner in W.P.No.107937 of 2018 are before this Court seeking for certiorari to quash the order dated 30.09.2007, passed by respondent No.2 at Annexure-H and consequently for a mandamus directing the respondents to allot alternative sites to the petitioners. Further in the alternative, if no alternate sites are available for grant than a direction to be issued to the State to award compensation to the petitioners as per the provisions of the Land Acquisition Act by way of initiating acquisition proceedings.
5. Brief facts of the case are as under:

It is alleged that the land bearing Sy.No.30 of Rayapur Village, Dharwad measuring about 133 acres 10 guntas is gomal land, since the said land was not used for any purposes, the Government is stated to have decided to form sites on a portion of the land and distribute the same to needy persons; as also allot a certain portion to public institutions.
