JUDGMENT - M.L. PENDSE, J.:---The petitioner is resident of Dombivali, a town in Thane district. The present petition is filed on December 7, 1989 seeking a writ of mandamus directing the respondents to delete the name of the petitioner from the surveillance register of Dombivali Police Station and also from the history sheet maintained by the said police station. The name of the petitioner was brought on the surveillance register on February 3, 1987, and as a consequence history sheet was prepared in respect of the activities of the petitioner. Before examining the complaint of the petitioner, it is necessary to set out the criminal cases which were filed against the petitioner between the years 1982 and 1986. On January 17, 1982 the petitioner was charged for offence punishable under sections 302 and 307 of Indian Penal Code. The prosecution ended in acquittal on June 29, 1985. On May 3, 1984 the petitioner was charged for having committed an offence of criminal trespass punishable under sections 451 and 506 of Indian Penal Code. This case ended in acquittal on March 20, 1989. The petitioner was prosecuted for possessing aims without proper licence on July 6, 1986 but this prosec
