Headnote:Section 37-Conditional surrender of land to landlord by tenant. Both the landlord as well as tenant have unequivocally stated that the land is being surrendered for the bona fide personal cultivation. If the land was not to be cultivated personally by the landlord, the tenant would not have surrendered this itself becomes doubtful. The surrender would be invalid in the eye of law in these circumstances. On making representation to the tenant for bona fide personal cultivation, it is not open now to contend that the surrender is not a conditional surrender.
