Bombay High Court
Joseph Fernandes
Versus
State of Goa
Decided On:

Headnote:Section 156-Police officer-In-charge-Proceeding of-Cannot be questioned on ground of having no right to Investigate.

It is true that it is only a Police officer in-charge of a Police Station who can investigate the cases within his jurisdiction as provided in Section 156(1), Criminal Procedure Code, but the High Court cannot ignore the specific provision in sub-clause (2) of Section 156 which clearly says that no proceeding of a Police Officer shall be called in question at any stage on the ground that he had no right to investigate.
