Headnote:Section 37-Criminal Procedure Code, 1973, Section 439-AccusedSeeking of ball on humanitarian grounds because his father to undergo angiorgraphy test for heart ailment-Though power of High Court under Section 439, Cr. P.C. superseded by Section 37, N.D.P.S. Act but it can grant bail on humanitarian ground-Such ground cannot be availed by accused because his two brothers present to look after his father.
