JUDGMENT-This is an appeal by the heirs of the original defendant against a decree for dissolution of partnership and for accounts in favour of the original plaintiff-Mahadeo, who is now represented by his heirs the respondents. Sheshrao, the original defendant, who shau here after be referred to as the defendant, and Mahadeo, the original plaintiff, who will hereafter be referred to as the plaintiff, entered into an agreement on 5.12-1949, which is styled as an agreement of partnership for running a cloth shop at Yeotmal in a building owned by the plaintiff. The plaintiff and the defendant had their own cloth business. The plaintiff was dealing in handloom cloth for which no licence was necessary, while the defendant was dealing in mill made cloth for which business a licence war required under the Cotton Cloth Trade Regulation Order, 1948, which was issued by the then Government of Central Provinces and Berar in exercise of the powers conferred by section 3 of the Essential Supplies (Temporary Powers) Act, 1946.
