The appellant is convicted for the offence punishable under Section 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988 and is sentenced to suffer rigorous imprisonment for one and half year and to pay a fine of Rs.1500/-, in default of payment of fine to further suffer rigorous imprisonment for nine months and under Section 7 of the Prevention of Corruption Act, 1988 and sentenced to suffer rigorous imprisonment for one year and to pay a fine of Rs.750/-, in default of payment of fine to further suffer rigorous imprisonment for six months by the learned Special Judge, Solapur in Sessions Case No. 6 of 1993 by its Judgment and Order dated 17th December 1997. It is directed that the substantive sentences to run concurrently. The said Judgment and Order dated 17.12.1997 passed by the learned Special Judge is impugned herein by way of the present appeal.
2. The facts which are relevant to decide the present appeal and are enumerated from the record can briefly be stated as under:
