The main legal point established in the judgment is that the University Grants Commission cannot refuse to issue a certificate of passing the NET test to a candidate based on the equivalence of a certificate/degree with a postgraduate degree, when the concerned university has already accepted and declared the certificate/degree as equivalent.

Headnote:

University Grants Commission - National Eligibility Test (N.E.T.) - Maharashtra Universities Act, 1994, University Grants Commission Act, 1956 - The court held that the University Grants Commission could not refuse to issue a certificate of passing the NET test to the petitioner as the concerned university had already accepted and declared the certificate/degree in 'Sangit Alankar' issued by the respondent no.7 as equivalent to a postgraduate degree of M.A. in Music.

Fact of the Case:

The petitioner sought a writ of mandamus directing the University Grants Commission and Secretary General, Association of Indian Universities to issue a certificate of passing National Eligibility Test (N.E.T.) for Lecturer in favor of the petitioner. The petitioner had passed the N.E.T. held in July, 2000, with a certificate in 'Sangit Alankar' from Akhil Bharatiya Gandharva Mahavidyalaya Mumbai, which the University Grants Commission refused to recognize as equivalent to a postgraduate degree.

Finding of the Court:

The court found that the concerned university had already accepted and declared the certificate/degree in 'Sangit Alankar' issued by the respondent no.7 as equivalent to a postgraduate degree of M.A. in Music. The court held that the University Grants Commission could not refuse to issue a certificate of passing the NET test to the petitioner.

Issues: The main issue was whether the University Grants Commission was justified in refusing to issue a certificate of passing the NET test to the petitioner based on the equivalence of the certificate in 'Sangit Alankar' with a postgraduate degree.

Ratio Decidendi: The court's decision was based on the fact that the concerned university had already accepted and declared the certificate/degree in 'Sangit Alankar' issued by the respondent no.7 as equivalent to a postgraduate degree of M.A. in Music. The court held that the University Grants Commission could not refuse to issue a certificate of passing the NET test to the petitioner.

Final Decision: The court allowed the writ petition and made the rule absolute in terms of the prayer clauses, directing the University Grants Commission to issue the certificate of passing the National Eligibility Test (N.E.T.) for Lecturer to the petitioner.
