This Appeal is directed against the Judgment and order dated 21st December, 2012, passed by the Sessions Judge, Pune in Sessions Case No.317 of 2011, thereby convicting the Appellant/accused - Suraj Jagannath Jadhav for the offence punishable under Section 302 the Indian Penal Code [for short 'IPC'] and sentencing him to suffer imprisonment for life and also to pay a fine of Rs. 100/-, in default of payment of fine to suffer rigorous imprisonment for six months. Hence this Appeal is filed by the Appellant challenging the conviction and sentence.
2. The prosecution case, in brief, is as under:
(A) Jayshree Suraj Jadhav [deceased] is second wife of accused - Suraj Jadhav. Accused Suraj married with Jayshree seven years prior to the incident and out of the said wedlock, a female child namely Swamini, aged about six years, was born. The couple was residing at Vitthalwadi, Dehugaon, Pune, an area where their other relatives also used to reside.
