JUDGMENT :
1. Heard Mr. P. P. Singh, learned Counsel for the Appellants in both these Appeals and Mr. Mahesh Amonkar, learned Special Public Prosecutor for the Respondents in both these Appeals.
2. Both these Appeals are directed against the Judgment and Order dated 24th September, 2014 in Special Case No.35/2013/D (Special Case No.2/2011 (old)) made by the Special Court for CBI in Goa at Mapusa. By the impugned Judgment and Order, the Appellant in Criminal Appeal No.59/2014 (Suresh Morajkar) was convicted for an offence punishable under Section 13(2), read with Section 13(1)(e) of the Prevention of Corruption Act, 1988 and sentenced to undergo rigorous imprisonment for four years and to pay a fine of Rs 1,00,00,000/-, in default, to undergo six months simple imprisonment. Similarly, the Appellant in Criminal Appeal No.63/2014 (Smt. Sushma Morajkar) was convicted for an offence of aiding her husband Suresh Morajkar in acquiring assets disproportionate to his known sources of income, which is punishable under Section 109 of the Indian Penal Code, 1860 (IPC), read with Sections 13(2) and 13(1)(e) of the Prevention of Corruption Act, 1988 (said Act) and sentenced to undergo simple impri
