JUDGMENT

Vyom PrakasH Gupta, J. In this revision petition the allegations against the petitioner (accused) are that he was paid an amount of Rs. 6,000/- on 5.10.1975 by one Amar Nath (Complainant) for disbursement to various persons and he executed a receipt in favour of complainant with respect to this fact. In the receipt the accused was given a list of the persons to whom the amount was to be disbursed. The complainant alleged that the accused did not disburse the amount and thus committed a criminal breach of trust on these allegations a complaint was filed on 20.5.1977.

2. The petitioner was charge-sheeted under section 406 IPC was finally convicted on 14.7.1982 by the Chief Judicial Magistrate, Kangra. He was sentenced to undergo rigorous imprisonment for six months and to pay a fine of Rs. 500/-. In default of payment of fine, he 'was to undergo simple imprisonment for two months.

3. The petitioner filed an appeal but the Additional Session Judge, Dharamsala, vide his order dated 22.11.1983 dismissed this appeal.
