JUDGMENT

A.S. Nehra, J.- The Petitioners have filed this petition under section 482 of the Criminal Procedure Code for quashing the impugned order I, dated 13-9-1990 under section 145, Cr. P.C. and order dated 3-1-1991 by which the objections filed by the petitioners were dismissed and the case was adjourned by the Sub-Divisional Magistrate, Nabha.

2. Briefly Slated, the facts are that the petitioners are sons of Amrik Singh son of Jagat Singh. The petitioner filed a suit against their father for declaration to the effect that they were owners to the extent of 31/60 share of the land. The suit was compromised and it was decreed in favor of the petitioners on 23-5-1984.

3. Amrik Singh had parted title of the land but still he sold the aforesaid land to Balwant Singh and Angrez Kauron 22-11-1989. Therefore, the petitioners filed a suit on 16-1-1990 challenging the sale and for a permanent injunction restraining respondent Nos. 1 and 2 from interfering in their possession. The Subordinate Judge granted and interim injunction on 18-4-1990 to the petitioners. The ad interim injunction granted in favor of the petitioners was confirmed by the Sub-Judge 1st Class, Amloh on 10-10-1990. The
