JUDGMENT
D.J. Jagannadha Raju, J. This Criminal Appeal is filed by the two accused who are convicted and sentenced by the Assistant Sessions Judge, Kothagudem in Sessions Case No. 97 of 1989. The Sessions Judge, by his judgment dated 28th May, 1990 convicted A-1 and A-2, the husband and the mother-in-law of the deceased Seetharathnam for offences under Sections 498-A and 306 IPC. A-1 and A-2 were sentenced to suffer R.I. for two years for the offence under Section 498-A IPC. For the offence under Section 306 IPC A-1 was sentenced to suffer R.I. for a period of five years. A-2, on the ground that she is a female, was sentenced to suffer R.I. for a period of three years for the offence under Section 306 IPC. Both the sentences to run concurrently. The Sessions Judge actually framed the first charge for the offence under Section 498-A IPC. The second charge was framed for the offence under Section 306 IPC Alternatively under the second charge he framed a charge for the offence under Section 304- B IPC.
