ORDER

M. Karpagavinayagam, J.-Jayaraman the petitioner herein, who is the first informant in C.C. No. 121/92 on the file of the Judicial Magistrate No. II. Poonamallee, challenging the judgment acquitting the respondents 1 and 2 in respect of the offences .under Sections 448 and 457 I.P.C. has filed this revision.

2. The facts of the case are this:

(a) The petitioner purchased the property in question, i.e. Survey No. 1371 Patta No. 570 situated at South Raja Street. in Railway Station Road Alandur one N.G. Vaidyalingam Chettiar. Five tenants were residing in the said premises. After purchase 3 tenants vacated the premises. Respondents 1 and 2 did not vacate, despite the notice, Hence, the petitioner filed RC. O.P. No. 190/84 before the civil court and obtained the order of eviction on 29-8-1990. Ex. P-2 is the Order and Ex. P-3 is the decree. As against the said order and decree, the respondents I and filed an appeal before the Sub Court in RC.A. No. 2/91 and the same was dismissed by the Sub Court by the order dated 5-8-1991. The said order is. Ex. P-4 and the decree is Ex. P-5.
