A.S.ANAND, DORAISWAMY RAJU, R.C.LAHOTI
Meena w/o Balwant Hemke – Appellant
Versus
State of Maharashtra – Respondent

Judgement Key Points

Certainly. Based on the provided legal document, the key points are as follows:

  1. The mere recovery of a currency note from the table pad of the accused does not constitute sufficient proof of acceptance of a bribe, especially in the absence of examination of shadow witnesses or corroborative evidence (!) (!) .

  2. Convictions based on evidence that is speculative, inconsistent, or not properly evaluated are subject to judicial scrutiny and can be overturned if found to be based on conjecture or erratic evaluation of record evidence (!) (!) .

  3. Essential elements to establish an offence under the relevant anti-bribery statutes include proof that the accused was a public servant, that the accused used corrupt means or abused their official position, and that they obtained a valuable thing or pecuniary advantage as a reward or motive for official acts (!) (!) .

  4. The prosecution must prove the guilt beyond reasonable doubt, and the presumption of innocence remains until such proof is established (!) (!) .

  5. The evidence presented, including the recovery of the currency note and the results of chemical tests, was deemed insufficient and not credible enough to establish the accused’s guilt, especially given contradictions and the absence of key witnesses such as shadow witnesses and the lady constable (!) (!) .

  6. The absence of critical witnesses who were part of the trap or present at the scene, and the contradictions in the testimonies of witnesses like PW-1, undermine the reliability of the prosecution’s case (!) (!) .

  7. The courts below failed to adequately consider the adverse impact of inconsistent witness testimonies and the withholding of material witnesses, which casts doubt on the guilt of the accused (!) (!) .

  8. The courts’ concurrent judgments do not preclude the Supreme Court from interfering where the findings are based on unsupported assumptions or manifest errors, and it is the duty to correct such errors to uphold justice (!) (!) .

  9. Ultimately, the evidence was insufficient to prove that the accused tacitly accepted the bribe, leading to the setting aside of the conviction and sentence, with the refund of any paid fines (!) (!) .

The appellant pleaded not guilty and sought for trial.

2. The prosecution examined PWs 1 to 7 and marked several documents in support of the charges. The appellant denied the charges and asserted that she was falsely implicated on the machinations of PW-3, PW-1 and one Jagdish Bokade, Shri Devanand was examined as DW-1.
