ORDER

M. Karpagavinayagam, J.- Crl. O.P. Nos. 2418 of 1999 and 1563 of 2000 are being disposed of in this common order as the issue and the parties in both the cases are one and the same.

2. M/s. Indian Oil Corporation, Chennai filed two complaints against the petitioners in C.C. No. 286 of 1998 on the file of the Judicial Magistrate, Alandur and in C.C. No. 299 of 1999 on the file of the Judicial Magistrate No .6. Coimbatore.

3. Though the complaint in C.C. No. 286 of 1998 was filed for the offences under Sections 378, 403, 405, 415 and 425 of I.P.C. the learned Judicial Magistrate. Alandur after taking sworn statement took the case on file under Sections 403, 405, 417 and 426, I.P.C. The respondent/complainant filed another complaint in C.C. No. 299 of 1999 against the petitioners for the offences under Sections 403, 406, 420 and 427, I.P.C. The learned Judicial Magistrate No.6. Coimbatore took the case on file for the same offences.

4. The Petitioners/accused in both the cases challenging both the complaints in C.C. No. 286 of 1998 on the file of the Judicial Magistrate. Alandur and C.C. No. 299 of 1999 on the file of the Judicial Magistrate No.6. Coimbatore have filed the quash
