Headnote:Criminal Procedure Code, 1973 - Section 451 - Offences complained of were u/ss 120-B, 467, 363, 397, 379, 201 & 414 IPC - Vehicle in question was stated to have been driven as a pilot vehicle for other vehicle containing stolen goods - Vehicle ordered to be released on certain terms & conditions. (Para 2)

       Result: Petition allowed.

       

ORDER

R. Balasubramanian, J. - Offences complained of are under sections 120-B. 467, 363, 397, 379, 201 and 414 I.P.C. The vehicle in question is stated to have been driven, by the petitioner as a pilot vehicle for the other vehicle containing stolen goods, which was following it. Having regard to the above materials. I am inclined to pass the following order:

2. The learned Judicial Magistrate No.2. Kancheepuram is directed to return the vehicle bearing Regn. No. TN 22-1-2997 concerned in Crime No. 255/2002 on the file of the respondent police to the petitioner on the following conditions:

(a) The petitioner produces documents to establish his ownership for the said vehicle before the learned Magistrate:

(b) executes a bond for a sum of Rs. 50.000/- (Rupees fifty thousand only) together with one surety for a like sum to the satisfaction of the said Magistrate:

(c) deposits the original Registration Certificate of the said vehicle with the court concerned:

(d) files an affidavit of undertaking to produce the said vehicle as and when called for by the said Magistrate in the condition in which it has been released to him: and

(e) gives an undertaking in the same affidavit that he will not alter the condition of the vehicle in any manner; alienate or encumber the said vehicle until further orders of the court.

Accordingly this petition is disposed of.

Petition allowed.
