P.S. Gopinathan, J.— This is a petition filed under Section 482 of the Code of Criminal Procedure. The petitioner is the respondent in M.C. No.67/2004 on the file of the Judicial Magistrate of the First Class-I, Perinthalmarma, a petition filed by the 1st respondent therein under Section 3(1) of the Muslim Women (Protection of Rights on Divorce) Act, 1986 (hereinafter referred to as Act 25/86). The petitioner married the 1st respondent in 1980. Though the matrimony was blessed with four children, the petitioner contracted a second marriage and started to ill-treat the 1st respondent. The 1st respondent moved OP No.123/2003 before the Family Court, Manjeri seeking dissolution of the marriage under Section 2 of the Dissolution of Muslim Marriage Act, 1981 and obtained Ex. Pl order dated 16.3.2004, whereby the marriage was dissolved.
