JUDGMENT (ORAL)

Ram Chand Gupta, J.—The present revision petition has been filed against judgment dated 3.1.2013 rendered by learned Sessions Judge, Fatehabad dismissing appeal filed by petitioner-accused against judgment of conviction dated 5.1.2011 and order of sentence dated 6.1.2011 passed by learned Judicial Magistrate First Class, Fatehabad vide which petitioner-accused was convicted for offence under Section 25 of the Arms Act, 1959 and sentenced to undergo rigorous imprisonment for one year and to pay fine of Rs.500 and in default of payment of fine to further undergo simple imprisonment for one month.

2. I have heard learned counsel for the parties and have gone through both the judgments rendered by learned courts below.

3. Briefly stated, on 6.1.2011 petitioner/accused was apprehended by the police party while on checking duty and on search one country-made pistol .32 bore was recovered from the possession of petitioner.

4. After completion of investigation, report under Section 173 Cr.P.C. was filed against petitioner-accused, who faced trial. He was convicted and sentenced by learned trial court as aforementioned. Appeal filed by him against the said judgment of convic
