JUDGMENT
Sureshwar Thakur, J.—The instant appeal, is, directed by the appellant/accused, against the impugned judgment rendered on 8.11.2004, by the learned Sessions Judge, Solan, H.P in Sessions trial No. 5-S/7 of 2004, whereby, the learned trial Court convicted and sentenced the accused/appellant to undergo rigorous imprisonment for a period of 10 years and to pay a fine of Rs.1,00,000/- and in default of payment of fine to undergo rigorous imprisonment for a further period of two years, for the commission of offence punishable under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the NDPS Act).
2. Brief facts of the case are that on 12.1.2004 Shri Ravi Kant Pawar, Intelligence Officer Narcotics Control Bureau, Chandigarh, the complainant, received an information that Narcotic drugs were being smuggled from Shimla side towards Chandigarh via National Highway No.22. This information was reduced into writing by the complainant and thereafter, he submitted the same to his superior official Shri O.P. Sharma, Superintendent, who, directed him to arrange a Naka near Timber Trail, falling within the jurisdiction of Police Station, Parwa
