JUDGMENT

Anil Kumar Choudhary, J.—Heard the parties through video conferencing.

2. This appeal has been preferred against the Judgment of Conviction and Order of Sentence dated 05.12.2011 passed by the Special Judge, C.B.I., Dhanbad in R.C. Case No.24 (A)/04 R whereby and where under the learned court below has held appellant-convict guilty of the offences punishable under Section 7 and Sections 13 (2) read with Section 13 (1) (d) of Prevention of Corruption Act, 1988 and sentenced him to undergo Simple Imprisonment for one and half years for the offence punishable under Section 13 (2) read with Section 13 (1) (d) of Prevention of Corruption Act, 1988 and further sentenced to Simple Imprisonment of one year for the offence punishable under Section 7 of Prevention of Corruption Act, 1988 and to pay a fine of Rs.1,000/- each for each of the offences i.e. in total Rs.2000/- and in default of payment of fine to undergo Simple Imprisonment for a period of 15 days for each offences and all the sentences were directed to run concurrently.

3. The case of the prosecution in brief is that the complainant Sohan Prasad Gupta was working as an E.D.M.C., in Raj Chainpur Sub- Post Office, Pala
