S.K. Sharma, Presiding Officer—This is an appeal filed by Sri Pradip Lahiri against the orders dated 12.3.2009 and 31.3.2009 passed by the learned Recovery Officer of this Tribunal in the case No. RC 25 of 2005.

The brief facts of the case are that a sale notice was published on 8.2.2009 in the daily newspaper ‘Sanbad Pratidin’ by the learned Recovery Officer of this Tribunal for the sale of the property situated within the District Hooghly, P.S. Serampore, Additional District Sub-Registry Office, Serampore, Mouza-Simla, Touzi No. 349, J.L. No.18, in connection with the case No. R.C. 25 of 2005.
3. The appellant has sent his offer in a sealed envelope as per terms and conditions given in the sale notice published on 8.2.2009. The other two parties namely, Sri Sukhendu Nath Sarkar and Sri Ajay Saria and Sri Aloke Saria have also submitted their offer in the sealed envelope with the learned Recovery Officer.
4. The parties were allowed to raise their bids on 12.3.2009 at the time of auction sale. The applicant raised his offer from Rs. 25,75,000 to Rs. 28,00,000 and then withdrew his offer. Sri Ajay Saria and Sri Aloke Saria raised their offer from Rs. 20,10,000 to Rs. 28,05,0
