Rajendra Kumar Mishra, J.—The petitioners have approached this Court under Section 482 of Code of Criminal Procedure, to quash the order dated 14.10.2004, passed m complaint Case No.1931 (C) of 2004 by the Court of Sri K.M. Tiwari, Judicial Magistrate, 1st Class, Patna, summoning the petitioners and one other accused, Bhanu Pratap Singh, on enquiry, finding prima facie case under Sections 403 and 418 of the Indian Penal Code. It appears that opposite party No.2, Ram Prasad Gupta, filed complaint petition numbered as complaint Case No. 1931 (C) of 2004, alleging that M/s Sisco Automotive (P) Ltd., Jawahar Lal Road, Muzaffar is a private limited company of which he is the Director and the witnesses Ramesh Prasad Gupta and Suresh Kumar Agrawal respectively, are Managing Director and Director. The accused No.1, M/s Usha International Limited, 19 Kasturba Gandhi Road, Cannaught Palace, New Delhi and accused Nos. 2, 3 and 4 Arvind Kumar Singh (petitioner No.1 ), RK. Shukla (petitioner No. 2) are respectively Divisional Manager, Sales Executive and Bhanu Pratap Singh Assistant Executive of local office, Patna of accused No.1, M/s Usha International Limited whereas, accused No.5 Si
