State Of Bihar
Miscellaneous Judicial Case No. 58 of 1957 ;
Decided On : APRIL 23, 1957
An order refusing permission to a candidate to appear in an examination is ultra vires if the candidate has fulfilled the conditions required by the relevant government circular and order.
Headnote:
CONSTITUTION OF INDIA, 1950 - ARTICLE 226 - WRIT OF MANDAMUS - SPECIAL LOWER DIVISION SECRETARIAT EXAMINATION - ELIGIBILITY - CONDITIONS - FULFILLMENT - ORDER REFUSING PERMISSION TO APPEAR AT EXAMINATION - ULTRA VIRES.
Fact of the Case:
The petitioner, a temporary assistant in the Northern Range office, was denied permission to appear in the Special Lower Division Secretariat Examination due to an order reverting him to his substantive post of typist Class II with effect from 21st May 1956. The petitioner challenged this order, arguing that it was not communicated to him until 29th January 1957 and therefore did not become effective before that date.
Finding of the Court:
The court found that the order reverting the petitioner was communicated to him and became effective only on 29th January 1957, and that on 30th August 1956, the petitioner had put in one year of continuous service as a Lower Division Assistant. Therefore, the petitioner had fulfilled the conditions imposed by the Government circular and order and was entitled to appear at the examination.
Issues: 1. Whether the order reverting the petitioner from the post of temporary assistant to the post of typist Class II was effective from 21st May 1956 or from 29th January 1957. 2. Whether the petitioner had fulfilled the conditions required by the Government circular and order to appear at the Special Lower Division Secretariat Examination.
Ratio Decidendi: The court held that the order reverting the petitioner was not communicated to him until 29th January 1957 and therefore did not become effective before that date. As a result, the petitioner had put in one year of continuous service as a Lower Division Assistant on 30th August 1956 and had fulfilled the conditions required by the Government circular and order to appear at the examination. Therefore, the order refusing permission to the petitioner to appear at the examination was ultra vires.
Final Decision: The court allowed the petition and issued a writ of mandamus commanding the respondents to publish the results of the Special Lower Division Secretariat Examination held on 7th February 1957, so far as the petitioner was concerned.
