Judgment

1. The petitioner seeking revision of an order dated 18th September, 2001 arising out of Title Suit no. 63 of 1996 : Mahesh Bhagat & Ors. Vs. Ram Sharan Sah and Ors. is himself to blame on the set of circumstances. The additional written statement for which permission had been granted had not been filed within time. Rightly the Court below did not accept the additional written statement after the period of filing was over. In the circumstances, the Court can hardly certify that the trial Court has committed any error.

2. For having delayed the proceedings the defendants shall pay a cost of Rs. 500/- within 15 days from today and thereafter the suit shall proceed. On failure to pay the cost the suit will proceed without the written statement.

3. With the aforesaid observation, this revision application is dismissed.

4. Let a copy of this order be sent to the Sub-ordinate Judge, Khagaria forthwith.
