1. Heard counsel for the petitioner and the State.
2. This application has been filed by the petitioner for a direction to the respondents to issue work order in favour of the petitioner for widening and strengthening Dalwas Road.
3. The tender notice was published in daily newspaper Dainik Jagaran inviting tender for the work of widening and strengthening of Shambhuganj Dalwa Path. The petitioner as well as other persons submitted their tender. The petitioner was not the lowest tenderer but he claims to be the second lowest tenderer. The documents submitted by the lowest bidder was found to be forged as such petitioner prayed that direction be issued to the respondents for treating him as lowest bidder and allocation of work in his favour. It has been submitted by the petitioner that he has already filed representation before the respondents.
4. In this circumstances I do not feel inclined to give any direction. However, if the representation, as claimed by the petitioner is pending before the respondents, it may be considered and if it is found proper and in accordance with law that the petitioner can be treated as second lowest tenderer, the respondents can pass such ord
