JUDGEMENT

Amaresh Kumar Lal, J.

1. In view of the order dated 21.11.2002 passed in Cr. Misc. No. 11453 of 2002, both the cases have been heard together.

2. In both the petitions, the Patna High Court CR. REV. No.124 of 2002 dt.22-07-2011 2 petitioners have challenged the order dated 6.12.2001 passed by the learned Judicial Magistrate, Siwan in Complaint Case No. 1288 of 2001, by which cognizance has been taken of the offences under Section 323 and 406 I.P.C. against them.

3. Learned counsel for the petitioners submits that petitioner, Vinay Kumar Sinha is the Senior Divisional Manager and the petitioner, Prasant Kumar Prasad was the Branch Manager of Life Insurance Corporation of India at the relevant time. The Life Insurance Corporation of India is a body corporate and has been created in pursuance of Section 3 of the Life Insurance Corporation of India Act, 1956. When the corporation was established, the Central Government specified the general duty of the Corporation to carry on life insurance business, whether in or outside India and the Corporation is to exercise its power under the Act as to secure the life insurance business is developed to the best advantage of the community
