This is an application under Articles 226 and 227 of the Constitution of India for the issuance of a writ of certiorari quashing the notice under section 3(1) of the Bihar Control of Crimes Ordinance, 1979 (hereinafter referred to as the Ordinance), contained in Annexure 1 to the application.

2. Petitioner Mahabir Prasad Akela claims to be a member of the Communist Party of India and one of its important functionaries being a member of the State Executive of the Party and Secretary of the Aurangabad District Committee. He was also a member of the Bihar Legislative Assembly from Nabinagar constituency in the year 1969-72. The relevant portion of the notice which is in Hindi, reads as under:
