Having heard counsel for the parties and taking into account the earlier application dated 28.06.2007, filed by the petitioner after the death of his father on 23.12.2006 was an invalid application in the eye of law, inasmuch as, the petitioner’s date of birth being 02.01.1990 was not major on the date of filing of such application, this Court would give an opportunity to the petitioner to file his fresh application in view of the fact that the period of limitation of five years for filing such application has still not expired.
If the petitioner therefore would files an application in the prescribed proforma with all other requisite details on or before 22.12.2011 as also would place other documents filed with the supplementary affidavit showing that he on being recommended by the authority of B.I.A.D.A had obtained training for the post of Bio-technician and was also given assurance by the B.I.A.D.A on 17.11.2009 for being considered for appointment on compassionate ground, the competent authority would take a final decision in this regard within a period of three months from the date of filing of the fresh application and other documents by the petitioner.
