1. The petitioner in this writ application has questioned the judgment and order dated 19.11.2018/23.11.2018 passed by the learned Deputy Registrar (Cane), Cooperative Societies, Bihar Patna in Election Case No. 92 of 2018. Since the appeal preferred by the petitioner against the order of the Deputy Registrar before the Registrar, Cooperative Societies, Bihar Patna was held not maintainable vide order dated 04.12.2018, the same has been challenged subsequent to filing of the writ application by filing I.A. No. 9737/2018. This court has been given to understand by learned counsel for the petitioner that for purpose of disposal of the case no notice is required to be issued to the private respondent nos. 7 to 16 because the contest is in fact between the petitioner and respondent no. 17. Respondent no. 17 has already appeared and has filed a counter affidavit which is available on the record. The matter was mentioned on urgent motion and the same has been taken up with the consent of the parties for final disposal.
