IN THE HIGH COURT OF JUDICATURE AT PATNA
Rajendra Menon, Rajeev Ranjan Prasad, JJ.
Rajesh Kumar Pandit @ Rajesh Pandit – Appellant
Versus
State of Bihar and Others – Respondents
Civil Writ Jurisdiction Case No. 13162 of 2018
Decided On : 10-07-2018
Bihar Prohibition and Excise Act - Confiscation - Section 56
Fact of the Case:
The petitioner challenged the confiscation of his motorcycle under the Bihar Prohibition and Excise Act, 2016. The District Magistrate had directed for release of the vehicle pending finalization of the confiscation case, but imposed additional requirements beyond the court's order.
Finding of the Court:
The Court found the District Magistrate's actions to be circumventing and disobeying the court's directions. It also highlighted that the Act does not provide for confiscation of a vehicle solely based on the driver being in a drunken condition.
Issues: The issues revolved around the District Magistrate's imposition of additional requirements and the legality of confiscating vehicles based solely on the driver being in a drunken condition.
Ratio Decidendi: The court emphasized that the Act only allows confiscation of specific items related to the commission of an offence under the Act, and does not provide for confiscation of a vehicle based solely on the driver being in a drunken condition.
Final Decision: The Court issued notice to the Chief Secretary, Government of Bihar, and the Collector of the District concerned to show cause as to why the confiscation proceedings should not be quashed and compensation granted to the affected individuals. The case was listed for further orders.
