JUDGMENT

1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Bihariganj PS Case No. 294 of 2019 dated 01.09.2019 instituted under Sections 25(1-B)(a)/26/35 of the Arms Act.

3. The allegation against the petitioner is that from the petitioner one countrymade pistol and three live cartridges were recovered.

4. Learned counsel for the petitioner submitted that the petitioner has been falsely implicated. It was further submitted that the petitioner having no other criminal antecedent is in custody since 02.09.2019.

5. Learned APP submitted that there is recovery of firearm and cartridges from the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 25,000/- (twenty five thousands) with two sureties of the like amount each to the satisfaction of the concerned Judicial Magistrate 1 st Class, Uda Kishanganj, District Madhepura in Bihariganj PS Case No. 294 of 2019. One of the bailors shall be a close relative of the petitioner. The petitioner and the bailors shall execute bond
