JUDGMENT :

S. KUMAR, J.

1. Heard learned counsel for the petitioner and learned counsel for the State.

2. Petitioner has prayed for the following reliefs:-

“(i) To issue an appropriate orders, directions including a writ preferably in nature of Mandamus commanding the respondents to release the vehicle/Maruti Suzuki Alto car bearing Reg. No. BR-09R-2104 Chassis No. MA3EUA61500461264 and Engine No. FBDN5246743 in favour of the petitioner who is owner of the said vehicle seized in Bakhri P.S. Case No. 96/ 2020 for the offences punishable under sections 30 (a) of Bihar Prohibition and Excise Act, 2016 lying in the premises of Police station and subject to natural decay by furnishing sufficient security to the satisfaction of learned ADJ-II-cum- Special Judge Excise Act, Begusarai.

(ii) For issuance of appropriate writ, order/direction commanding the respondents to release the vehicle of the petitioner during the pendency of the confiscation proceeding a reasonable surety till the disposal of the said confiscation proceeding.

(iii) Any other reliefs to which the petitioner is entitled in the facts and circumstances of the case.”
