.
Lala Hemanta Kumar and Sudhir Kumar Dutt - for Petitioners.Baidyanath Bannerjee and Profulla Kumar Chatterjee - for Opposite Party.
The right to appeal against an order overruling objections to the filing of an award and directing a decree in terms of the award is not precluded by the same order.
Headnote:
Appeal - Filing of Award - Right to Appeal Against Order Overruling Objections and Directing Decree - Indian Arbitration Act 1940
Fact of the Case:
The defendant obtained a rule against an order of the Munsiff overruling objections to the filing of an award and directing a decree to be drawn up in terms of the award.
Finding of the Court:
The court held that the fact that the objections to the filing of the award were overruled and a decree was directed in the same order did not take away the right of the aggrieved party to file an appeal in accordance with the provisions of S. 39, Indian Arbitration Act 1940.
Issues: The issue was whether the aggrieved party had the right to file an appeal against the order overruling objections to the filing of the award and directing a decree to be passed in terms of the award.
Ratio Decidendi: The court relied on the decision in Sheocharan Mahton v. Samchar Mahton and analogous provisions of the Code of Civil Procedure to support the view that the aggrieved party had the right to file an appeal despite the order directing a decree to be passed in terms of the award.
Final Decision: The rule was discharged with costs, and the petitioner was allowed to prefer any appeal against the order of the proper Court.
2. In my opinion the fact that by the same order the Munsiff overruled the objections to the filing of the award and also directed a decree to be passed in terms of the award does not take away the right of the aggrieved party to file an appeal in accordance with the provisions of S. 39. This view is supported by the decision in the case of Sheocharan Mahton v. Samchar Mahton, AIR (35) 1948 Pat 207 : (26 Pat 115). Before the enactment of the Indian Arbitration Act 1940, under the analogous provision of the Code of Civil Procedure where an appeal lay against an order filing or refusing to file an award under S. 104(f), Civil P.C., in cases where the arbitration was not through the intervention of the Court, the mere fact that the objections to the filing of such an award were overruled by one and the same order by which a decree was also passed in terms of the award did not preclude the party aggrieved by such an order from availing himself of the right of appeal which he had under S. 104(1)(f), Civil P.C. (See the cases of Kshetra Nath v. Ushabala Dasi, 18 C. W. N. 381 : (AIR (1) 1914 Cal 899) and Troilokya Nath v. Sukumar Boss, 44 C. W. N. 1034 : (AIR (28) 1941 Cal 202).)
3. The petitioners remedy was therefore to prefer an appeal against the order complained of before the proper Court. This rule is accordingly discharged with costs, hearing fee one gold mohur.
4. This order will not however stand in the way of the petitioner preferring any appeal which he may choose to file against the order of the proper Court.
Rule discharged.
