This application under s. 482 of the Code of Criminal Procedure 1973, sent through the Superintendent, Presidency Jail, by the petitioner Peter Bleach, one of the accused persons placed on trial before the Ld. Sessions Judge, IVth Bench, City Sessions Court, Calcutta, in Sessions Trial No. 1 (June) of 1997, is directed for quashing of the charges framed against him at the trial and stay of further proceeding in the matter besides judicial enquiry in the matter and his release on bail.
2. The petitioner prayed for appearing before this court in person and making his submissions in support of the application and the said prayer for appearing in person was allowed by this court and the petitioner in person and the Ld. counsels appearing on behalf of C.B.I. have been heard at length for several days.
3. In brief, the submissions of the petitioner are that he is innocent and the charges framed against him are untenable in law in the facts, circumstances and the materials on record and the petitioner has been seriously prejudiced for non-consideration of his defence at the time of framing of the charge by the trial court.
