This appeal arises out of the judgment of conviction and order of sentence dated 29.12.2007 passed by the III Additional Sessions Judge (FTC), Raigarh in ST No.89/2007 convicting the appellant under Section 302 of IPC and sentencing him to undergo imprisonment for life and to pay a fine of Rs.1000/- with default stipulation.
2. In the present case, name of the deceased is Lalita, wife of the accused/appellant. As per prosecution case Lalita was living with the appellant, her daughter aged 1½ years and mother-in-law. On 24.5.2007 at around 12 noon Bhajanbai Satnami (PW-4), mother of the appellant, returned to her house and found Lalita lying on the floor in the pool of blood and then information was passed on to relatives of Lalita that Lalita is serious. Having received such information PW-1 Kiritram Navrangi, brother-in-law of the deceased, reached the house of the deceased and found that she had expired. At his instance merg intimation Ex.P/2 was registered on 24.5.2007 at 7.30 pm. Immediately thereafter FIR (Ex.P/1) was registered at 7.35 pm against the appellant under Section 302 of IPC.
