( 1 ) THIS is plaintiffs suit for rendition of accounts and recovery of the amount found due to the plaintiff from the defendant.
( 2 ) THE facts as stated in the plaint are that the plaintiff was carrying on the business under the name and style of M/s. Foreign Linkers (Personnel ). The plaintiff was duly registered recruiting Agent under the Indian Emigration Act of 1922 (hereinafter referred to as the Act ) and was also governed by the guidelines issued by the Supreme Court by its order dated March 20,1979 in this regard. According to the plaintiff the defendent had taken up the project for the construction and completion of a Dam at MOSUL in Iraq. On 2nd/4th September, 1981 the plaintiff and the defendent entered into an agreement whereby the former was required to supply manpower from India to the latter at the construction site of the dam in Iraq. The defendent which is a company based in West Germany also appointed the plaintfiff as its agent vide its power of attorney dated 2nd/4th September, 1981 for the purpose of recruitment of Indian manpower in accordance with the terms and conditions of the aforesaid agreement.
