( 1 ) THESE two appeals arise from the same judgement of the Additional Sessions Judge, so they are being disposed of by this common judgement.

( 2 ) APPELLANT Shanker and appellant Prem Chand were charged for an offence punishable under S. 392 read with S. 397 of the Indian Penal Code for having committed robbery on Mar. 14, 1985, at house No. C-1/19, Safdarjang Development Area, New Delhi, at about 2. 30 p. m. of one VCR make National Panasonic 370, one two-in-one make National Panasonic, one another two-in-one make Sharp and one transistor make Phillip belonging to Smt. Uma Malhan.

( 3 ) VIDE judgement dt. Oct. 4, 1988, Shri S. C. Jain, Additional Sessions Judge, had sentenced accused Prem Chand to undergo rigorous imprisonment for five years and to pay a fine of Rs. 500/- and in default to further undergo simple imprisonment for one month under S. 392, I. P. C. , and had sentenced accused Shanker to undergo rigorous imprisonment for seven years and to pay a fine of Rs. 200/- and in default to further undergo simple imprisonment for one month under S. 392 read with S. 397, I. P. C.
